Well, SCOTUS ruled several years ago that Creationism is not science but religion, and thus shouldn't be taught in public schools. So, the Creationism folks changed Creationism to "Intelligent Design." A 1st Amendment case discussing the mandatory teaching of Intelligent Design hasn't reached SCOTUS yet, but even if it did, even our current conservative Court wouldn't allow it.
But what SCOTUS issues and what local practice deems acceptable are two different things.
